Two TN acts govern the First Colony HOA (below). The underlines are hyperlinks.
TN Nonprofit Corporation Act: Since most HOAs are organized as nonprofit corporations, this act governs their structure and operations. It mandates the adoption of bylaws, sets requirements for directors and officers, and outlines the rights and responsibilities of these organizations, etc.
TN Horizontal Property Act: TN uses the term "Horizontal Property Regimes" (HPRs) to describe laws governing individual ownership of units within a larger property while sharing ownership/responsibilities for common areas. The concept has evolved to support diverse housing forms. Our Master Deed refers to First Colony as an HPR. The act establishes the frameworks for property division, shared responsibilities, and governance. Rules must be formally submitted through a recorded master deed that includes detailed descriptions of each unit, specifies boundaries, establishes the percentage ownership interest each unit holds in common elements (effects voting rights and financial obligations), establishes a governing body (e.g., HOA) to oversee management and enforcement of rules, procedural rules for amending master deed, openness of books to owners, etc. There is also a Display of Signs code. There is also a Special Assessment Levy for Nonessential Amenities code.
